Summary Appeal Courts
In the last few years service personnel have been granted the same rights as civilians to appeal against either the conviction or sentence by a lower court – in this case the CO – to a Court Martial in the form of a Summary Appeal Court (SAC). Many people do take up this opportunity and are successful in overturning the CO’s decision. The penalty in an SAC cannot be increased, it can only go down or stay the same, so arguably there is little to lose. Free legal aid from AFCLAA is available and Foster Wells can offer advice and representation.
